Robert P. Monyak

Mr. Monyak graduated with highest honors from the University of Notre Dame in 1981 and from Duke Law School in 1984, where he was an editor of the Duke Law Journal and ranked in the top 10% of his class.  He served as a law clerk for the Honorable Albert J. Henderson of the United States Court of Appeals for the Eleventh Circuit from 1984-1985 and entered private practice thereafter.

Mr. Monyak has devoted himself exclusively to the practice of civil litigation, specializing in the defense of medical malpractice cases, professional liability actions, and products liability claims.  He has defended hundreds of physicians and other healthcare providers, numerous hospitals and other healthcare institutions, and a broad array of product manufacturers.  He has extensive experience in the trial and appeal of civil cases, and has appeared many times before the Court of Appeals and Supreme Court of Georgia and the United States Court of Appeals for the Eleventh Circuit.  Mr. Monyak is among the most active attorneys in Georgia in the representation of healthcare professionals in negligence and credentialing actions and before the Georgia Composite State Board of Medical Examiners. 

Mr. Monyak is experienced in a variety of other types of civil cases.  Among other things, he has represented national and regional businesses and other clients in cases involving non-medical professional and business liability, commercial contract disputes, employment agreements and covenants not to sue, protection of trade secrets and other proprietary information, and alleged business fraud.

Mr. Monyak is a Fellow of the prestigious American College of Trial Lawyers, and has been recognized by the national publication, “Best Lawyers in America.”  For the past 9 years, he has also been designated by Atlanta Magazine as a “Georgia Super Lawyer,” signifying his ranking among the top 5% of practicing attorneys in the field of personal injury defense.  He is a longstanding member of the Defense Research Institute, the Georgia Hospital Association, and the State Bar of Georgia.  Mr. Monyak is a member of the State Bars of both Georgia and Florida.

As a founding partner of Peters & Monyak, LLP, Mr. Monyak is an authority on the defense of medical professional and products liability cases. He has been specially retained to file appellate briefs in high-profile medical malpractice and products liability cases, regularly prepares amicus curiae briefs advocating the public policy positions of various industry and professional organizations, and is invited regularly to speak to attorney and community groups and organizations on a variety of civil trial and appellate litigation topics.
